Abdul Nazar Madani v. State of Tamil Nadu and Another
"Transfer of a criminal case under Section 406 CrPC requires proof of a reasonable, substantiated apprehension that justice will not be done; subjective fear or localized media agitation is insufficient."
Issues Before the Court
- (i)
Under what circumstances can a criminal trial involving grave bomb blast conspiracy charges be transferred from one State to another under Section 406 CrPC?
- (ii)
Does mere media agitation or adverse public sentiment in a locality justify transferring a trial, or must there exist a tangible apprehension of institutional bias?
Law & Rules Applicable
- (i)
Code of Criminal Procedure, 1973, Section 406 (Power of Supreme Court to transfer cases and appeals); now Section 446 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
- (ii)
Constitution of India, Article 21 (Right to a fair and impartial trial).
- (iii)
Doctrine of Judicial Impartiality and Objective Apprehension.
Application to Facts & Circumstances
Abdul Nazar Madani and 152 co-accused in the 1998 Coimbatore serial bomb blast case sought transfer of the trial from Coimbatore, Tamil Nadu, to Kerala, alleging that the communal atmosphere in Tamil Nadu made a fair trial impossible.
The Supreme Court held that the primary purpose of criminal jurisdiction is to try offenses locally where they occurred. Transferring a trial under Section 406 CrPC is an exceptional power.
The apprehension of not getting a fair and impartial trial must be reasonable and grounded on substantiated facts, not on mere subjective conjectures or hypersensitive suspicions.
The Court accepted that there had been communal tension, but found no material to show that the State as a whole had become unsuitable for an impartial trial. It held that the "apprehension of not getting fair trial must be reasonable and not imaginary".
Conclusion & Ruling
- (i)
Criminal proceedings cannot be transferred from one state to another on whimsical or fanciful grounds; the petitioner must prove demonstrable institutional bias or total breakdown of security.
- (ii)
Public interest and logistical hardship to hundreds of local witnesses weigh heavily against interstate transfer of complex criminal trials.
- (iii)
The transfer petitions were dismissed, and the Court directed that the trial at Coimbatore, where special arrangements had been made for the 168 accused, be conducted expeditiously.
